The Equal Employment Opportunity Commission (EEOC) is working on new guidance on reasonable accommodation under the Americans with Disabilities Act in light of the emphasis the recent ADA Amendments Act places on accommodating workers with disabilities. The EEOC anticipates an increasing focus by employers and courts on reasonable accommodation in the wake of the amendments. According to the EEOC, it helps to consider reasonable accommodation as a “continuum” of issues, including whether accommodation is required, whether proposed accommodations are reasonable, and whether an employer can claim undue hardship as the basis for refusing an accommodation. 01.11.2012
