On November 14 The U.S. Supreme Court granted review in three cases that focus on issues surrounding the Patient Protection and Affordable Care Act (Nat’l Federation of Independent Business v. Sebelius, No. 11-393; Dep’t of Health and Human Services v. Florida, No. 11-398; and Florida v. Dep’t of Health & Human Services, No. 11-400). A central issue the court will consider is the constitutionality of PPACA’s individual mandate, a provision set to take effect in 2014 that would require virtually all citizens to maintain health insurance coverage or pay a penalty. Other questions the court agreed to consider include whether the rest of the statute can survive if the individual mandate is struck down, and whether lawsuits challenging the mandate are barred by the federal Anti-Injunction Act. The court is expected to decide the cases by the summer of 2012.  11.15.2011
